These Terms of Use (“Terms”) apply to your use of namestake.com (the “Site”), operated by Newviato Ventures LLC, a California limited liability company (“Namestake,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

What Namestake provides

The Site offers free tools, checklists and general information to help you choose, check and claim a brand name, and lets you express interest in our other services. Any paid services, such as Namestake Protect, are provided under separate terms that we will share with you before you sign up.

Not legal, tax or financial advice

Everything on the Site is general information and education only. It is not legal, tax, investment or other professional advice, and using the Site does not create an attorney-client or other professional relationship. Before registering a business name or trademark, or making legal or financial decisions, consult a qualified professional, such as a trademark attorney.

No guarantee of name availability

The name checker only helps you search outside sources. We do not check, confirm or guarantee that any name, web address, social media handle or trademark is available, or that you have the right to use it. Search results are a starting point. Always confirm with the official sources before you register or use a name.

Outside websites

The Site links to websites we do not own or control, including domain sellers, government agencies, search engines and social media sites. We are not responsible for their content, accuracy, availability or practices, and your use of them is subject to their own terms. Some links may be affiliate links, which means we may earn a commission if you make a purchase, at no extra cost to you.

Using the Site

You agree not to misuse the Site. For example, you may not try to break its security, interfere with how it works, use it for anything unlawful, or copy it to build a competing service.

Our content and brand

The Site’s content, design and logo, and the Namestake name, belong to Newviato Ventures LLC and are protected by copyright and trademark laws. You may view and print pages for your own personal, non-commercial use. Please do not otherwise copy, change or distribute them without our written permission.

Disclaimer

The Site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available or free of errors.

Limitation of liability

To the fullest extent allowed by law, Namestake will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or business, arising from your use of the Site, including any decision you make based on information or search results from the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).

Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. If you keep using the Site after that, you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
